description
the workers’ rights division is responsible for providing advice to the bureau of contract administration’s office of wage standards and contract compliance, council offices and city departments related to various social policy and workers’ rights issues. The workers’ rights division also advises council offices on social policies including policies that provide rights and protections to workers in the city of los angeles and workers of city contractors.

duties and responsibilities
in serving as advisor on all matters involving workers’ rights and protections, the attorneys in the division provide oral and written advice on a myriad of issues, such as statutory and constitutional interpretation and application of various worker protection laws, including but not limited to the city minimum wage ordinance, the city hotel minimum wage ordinance, fair work week, fair chance initiative, freelance worker protection, misclassification under the abc test, and other related labor laws.

The attorneys in the division also advise the bureau of contract administration in its implementation and enforcement of social policies required of city contractors. These include the living wage ordinance, bid preference policies, business certifications, prevailing wage and labor peace agreements. The attorneys collaborate with council offices throughout the legislative process, including the legal analysis, drafting, and implementation of new ordinances designed to provide greater protections and rights to the city’s private sector workers.

Additionally, the attorneys in the workers’ rights division assist on specialized litigation and administrative proceedings relating to enforcement of city ordinances in furtherance of combatting wage theft across the city. The attorneys also advise on the public records act, ralph m. Brown act, and liability assessment and risk management, and perform other duties as assigned.

requirements
applicants for this position must have a valid license to practice law in all of the courts within the state of california. Additional requirements include:

  • minimum five years of experience in the practice of law;
  • experience with and/or a working knowledge of the national labor relations act (nlra);
  • strong communication skills;
  • strong research and writing skills in complex areas of law;
  • demonstrated abilities to exercise sound judgment;
  • ability to work effectively with governmental agencies, public officials, departmental personnel, and members of the public; and
  • licensed to practice law in all courts in the state of california and the united states district court for the central district of california.

desired qualifications

the following qualifications are highly desirable:

  • experience in wage and hour and employment litigation;
  • experience with administrative enforcement actions;
  • experience in drafting local ordinances and knowledge of the city charter; and
  • civil litigation experience (minimum of two years preferred) and experience in quasi-judicial administrative hearings by public bodies.
