Job Overview
The Criminal Defense Investigator plays a pivotal role in the defense of clients represented by the Office of the Public Defender. Under general direction of counsel, this position conducts investigations into a broad range of alleged violations of criminal law, dependent neglect matters and other circumstances to assist in the representation of clients. Responsibilities include gathering and examining evidence, conducting interviews, serving subpoenas, and testifying in court.

Functions
- Conduct investigations for the defense of clients, including specialized crime scene and interview techniques, and cooperating across multiple jurisdictions.
- Coordinate investigations with OPD attorneys and other counsel to ensure unified and effective defense strategies across Montana.
- Interview suspects and witnesses, perform research, gather and analyze evidence, and identify exculpatory evidence.
- Review and analyze reports, interviews, and evidence to aid defense counsel and verify proper evidentiary handling.
- Prepare clear, concise reports that explain the scope and results of investigations in accordance with OPD policies.
- Testify in courts, hearings, or depositions on behalf of the defense.
- Collaborate, develop, and maintain rapport with other offices, agencies, and the public to obtain or exchange investigative information.
- Obtain and serve subpoenas.
- Provide training, advice, and leadership on investigation techniques and procedures, including training for new investigators.
Other Duties (10%)
- Conduct background investigations for OPD employment.
- Support other OPD work units and provide backup for co‑workers as needed.
- Maintain investigation equipment and vehicles according to rules and policy.
- Secure evidence held by the OPD and update the evidence locker to preserve items and release obsolete property.
- Assist in initial screening of clients when required.
Physical and Environmental Demands
This position regularly requires field work, including visits to crime scenes, bars, gambling establishments, detention centers, hospitals, private residences, and courtrooms. It involves exposure to stressful and potentially dangerous situations and requires irregular hours and occasional overnight travel (20% of the time). Travel may be required across Montana to assist other investigators as needed.

Skills and Abilities
- Comprehensive knowledge of criminal investigation principles, procedures, and Montana criminal law.
- Knowledge of evidence collection methods and procedures.
- Proficiency in conducting interviews and gathering information from various sources.
- Strong verbal and written communication skills, able to convey technical and non‑technical information.
- Understanding of criminal justice processes, law enforcement and jail procedures.
- Ability to prepare accurate reports with findings, conclusions and recommendations.
- Computer skills, including spreadsheets, word processing, databases, email and internet usage.
- Ability to develop and maintain professional working relationships with agencies, the public and clients.
- Follow written and verbal instructions, plan, organize and gather information effectively.
- Respond to situations independently and track multiple details simultaneously.
- Maintain high work standards under strict deadlines and pressure.
- Travel and operate a motor vehicle as required.
Minimum Qualifications
- Bachelor’s degree in Criminology, Sociology or a closely related investigative field.
- Two (2) years of progressively responsible investigative experience.
- Other combinations of education and experience may be considered on a case‑by‑case basis.

Compensation
Hourly rate will increase by $1.00 per hour or 2.5%, whichever is greater, effective July 1, 2026, in accordance with HB13.
Annual salary range: $64,145.46 – $71,405.00.
